Terms of Service

1. Purpose and acceptance
Welcome to SparkleQuiz. These terms of service govern access to and use of the sparklequiz.fr website and the SparkleQuiz mobile app: solo and multiplayer quiz games, quiz creation, clubs, leaderboards, messaging and related features. By creating an account or using the service, you accept these terms without reservation. If you do not accept them, please do not use the service.
2. Description of the service
SparkleQuiz is a quiz and general-knowledge platform offering a catalogue of official quizzes organised by theme, real-time multiplayer games, an adventure mode with level-based progression, daily challenges, and tools that let members create and share their own quizzes. Some features are available without an account; others (progress saving, clubs, quiz creation, messaging) require registration.
3. User accounts
You can register with an email address, a Google account or an Apple ID. You agree to provide accurate information and to keep your credentials confidential: any activity performed from your account is deemed to be yours. Notify us without delay of any unauthorised use. We may suspend or delete an account in the event of a breach of these terms, fraud, or behaviour harmful to other members.
4. Premium subscription and purchases
SparkleQuiz offers a paid Premium subscription that unlocks additional benefits (content, customisation, quality-of-life features). On the web, payments are processed by our provider Stripe; on mobile, by the app stores (Google Play / App Store). Prices, duration and what the offer includes are shown before any payment. The subscription renews as described at the time of purchase and can be cancelled at any time from your account or the app store; cancellation takes effect at the end of the current period. In-game virtual items (coins, hearts, cosmetic items) have no monetary value: they cannot be exchanged or converted into real money, and remain tied to your account. A purchase made with real money can, however, be refunded under the conditions of section 5.
5. Terms of sale
These terms apply to every purchase made on SparkleQuiz with real money: the Premium subscription (monthly or yearly), coin packs, heart packs and the "No ads" option.
Prices. The price is shown before any payment. On the website, it is given in euros, all taxes included. In the apps, it is the price set by the app store, in your currency, taxes included.
Payment. On the website, payment is processed by our provider Stripe: we never see or store your card details. In the apps, the purchase is billed by Apple (App Store) or Google (Google Play), with your store account.
Delivery. What you buy (Premium, coins, hearts, the "No ads" option) is credited to your SparkleQuiz account as soon as the payment is confirmed.
Subscription renewal and cancellation. The Premium subscription renews automatically at the end of each period, monthly or yearly, until it is cancelled. You can cancel it at any time, where you took it out:
- on the website: Settings › Subscription › Cancel my subscription, which opens Stripe's secure page;
- on iPhone: in your Apple ID subscriptions (App Store);
- on Android: in Google Play, under Payments and subscriptions.
Cancellation takes effect at the end of the period already paid for: you keep Premium until that date. Deleting your account cancels a subscription taken out on the website, but not one taken out in an app store, which you need to cancel in the store.
Right of withdrawal. As a consumer, you normally have 14 days to withdraw from a distance purchase. This right no longer applies to digital content supplied immediately, once you have asked for it to be supplied before the end of that period and expressly waived your right of withdrawal (article L221-28, 13° of the French Consumer Code). On the website, before being taken to the payment page, you tick a box that is never ticked in advance: "I ask to enjoy my purchase right away and I waive my 14-day right of withdrawal." Without that box, payment does not open. By ticking it, you ask for your purchase to be supplied right away and you expressly waive your right of withdrawal, which ends as soon as the purchase is credited to your account. We keep the date and time of that choice with your payment. In the apps, the purchase is made in the App Store or Google Play, and Apple's or Google's rules apply, including for withdrawal.
Refunds. A refund is requested from whoever collected the payment:
- purchase on the website: write to us through the contact page, with the date and amount of the purchase; every request is reviewed;
- purchase in the App Store or Google Play: the request is made to Apple or Google, who decide under their own rules. We cannot refund a payment we did not collect.
What a refund does. What the purchase gave you is removed from your account: a refunded subscription stops immediately, the "No ads" option is removed, and the coins or hearts you bought are taken out of your balance, up to what it still holds. The same applies when your bank reverses a payment after a dispute. A partial refund is handled case by case.
6. User-created content
You keep your rights over the quizzes and content you create, and you grant us a non-exclusive licence to host, display and distribute them on the platform. You warrant that your content does not infringe any third-party rights and contains nothing unlawful, defamatory, hateful or inappropriate. We reserve the right to moderate, remove or unpublish any content that is reported or that breaches these terms.
7. Rules of conduct
It is forbidden to use the service to cheat (automation, exploiting bugs, abusive multi-accounting), to harass other members, to impersonate anyone, to collect other users' data, or to disrupt the technical operation of the platform. Violations may lead to a warning, suspension or deletion of the account, without prejudice to any legal action.
8. Intellectual property
The SparkleQuiz platform (texts, official questions, graphics, logos, illustrations, code and databases) is protected by intellectual-property law. Any unauthorised reproduction, extraction or reuse is prohibited. Third-party trademarks and logos mentioned remain the property of their respective owners.
9. Availability and liability
We strive to keep the service available and reliable but cannot guarantee absolute continuity: maintenance, updates or outages may occur. The service is provided "as is"; to the extent permitted by law, we cannot be held liable for indirect damages arising from its use. Nothing in these terms limits the mandatory rights you enjoy as a consumer.
10. Changes to these terms
We may update these terms to reflect changes in the service or in regulation. In the event of a substantial change, a notice will be displayed on the platform. Continued use after publication constitutes acceptance of the updated terms.
11. Governing law and contact
These terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any action; failing that, the French courts will have jurisdiction, subject to the protective rules applicable to consumers.
